Donations have become an integral part of streaming culture. Viewers transfer money to their favorite bloggers to support their creativity, get a reaction on air, or simply express gratitude. But what happens when a donor changes their mind? Can you get a refund for a streamer donation? This question concerns both viewers who accidentally transferred a large sum and streamers who may face a refund request. In this article, we will analyze the legal nature of donations, cases where a refund is possible, and provide recommendations on how to avoid conflicts.

What is a donation from a legal perspective?

Before discussing refunds, it's important to understand what a donation is in the legal field. The word "donate" comes from the English "to give." In a legal sense, a donation is a voluntary contribution, which by its nature is close to a gift agreement.

However, there is an important nuance here. If a viewer transfers money and receives nothing in return, it is a pure gift. But as soon as the donation is accompanied by a streamer's reaction (reading a message, fulfilling a request, participating in a giveaway), the legal relationship can be qualified differently – as a paid service or even a contract for work.

Why this is important: whether a donation can be refunded depends on its legal nature. A gift is practically non-refundable, while a paid service is quite possible to refund.

Donation as a gift: when a refund is not possible

As a general rule, a donation to an individual is not refundable. Article 578 of the Civil Code of the Russian Federation allows for the cancellation of a gift only in exceptional cases:

  • If the donee (streamer) attempted to take the life of the donor or their close relatives.
  • If the donee treats the gift in such a way that there is a threat of its irretrievable loss.
  • If the gift was made in anticipation of future obligations that did not materialize.

All these cases are unlikely in the context of streaming. Therefore, a donation as a voluntary contribution is practically impossible to refund. Even if a viewer accidentally transferred an amount or made a mistake, the law does not provide a mechanism for returning a gift.

However, judicial practice knows cases where donations were still successfully refunded. Let's examine them in more detail.

When a donation can be refunded: exceptions to the rules

Despite the general rule, there are situations in which a donation refund is possible. Let's look at the most common ones.

Donation from a minor

This is one of the most common situations where a donation refund is possible. According to Article 28 of the Civil Code of the Russian Federation, minors aged 14 to 18 enter into transactions with the written consent of their parents. Donating a large sum can be recognized as a transaction requiring approval.

If a child transferred money to a stream without the knowledge of their parents, the latter can go to court to demand a refund. Judicial practice knows cases where such claims were satisfied, especially if the amount was significant.

However, there is a difficulty here: the streamer may not know that the donor is a minor. The platform administration usually does not provide users' age data. Therefore, responsibility for controlling the actions of minors lies with their parents.

Streamer's refusal to fulfill donation conditions

If a donation was made under a specific condition (for example, the streamer promised to sing a song, draw a picture, or perform another action), and then failed to fulfill it, this can be considered unjust enrichment under Article 1102 of the Civil Code of the Russian Federation.

The donor has the right to demand a refund if the streamer did not provide the promised service or result. This will require confirming the agreement – screenshots of correspondence, stream recordings, donation description.

Deception or fraud by the streamer

If a streamer deliberately misleads viewers, promising riches in exchange for a donation, and then disappears or refuses to fulfill obligations, this can be qualified as fraud (Article 159 of the Criminal Code of the Russian Federation). In this case, the viewer can contact law enforcement agencies.

Example: a streamer announces that they are collecting money for charity, but spends it on personal needs. This is no longer a civil dispute, but a criminal case.

Technical error or card fraud

If money was transferred accidentally or as a result of fraudulent actions, you can try to get it back through the bank. In this case, you need to:

  1. Immediately contact the bank and block the card.
  2. Write a statement to dispute the transaction (chargeback).
  3. If the money has already reached the streamer, the bank may request it back.

However, it should be noted: banks do not always cooperate, especially if the transfer was made voluntarily and with confirmation.

What a donor should do if they want a refund

If you have transferred money to a streamer and want to get it back, here is a step-by-step guide:

Step 1. Contact the streamer directly

Write a private message or email, explain the situation. Perhaps the streamer will be accommodating, especially if the error is obvious.

Step 2. Check the platform's policy

Step 3. Contact your bank

If the streamer does not respond or refuses, try to dispute the transaction through your bank. The chances of success are higher if the operation was performed using a credit card.
